How to get Viet Nam visa – Visa means a document issued by a competent authority of Vietnam to a foreigner to grant entry into Vietnam. A visa may be used once or multiple times and its purpose must not be changed.

If you are a foreigner and would like to come to Vietnam to work, you have to be issued a work visa. You shouldn’t apply for a DL visa to enter Vietnam to work because a DL visa is issued for tourists and has a duration of no longer than 03 months. There are 3 popular types of visas to enter Vietnam to work.

I . Business visa

DN1 visas and DN2 visas are issued to people who come for business purposes.

The duration of the DN visa is not longer than 12 months and is categorized as DN1 and DN2 visas. DN1 visa – to be granted to foreigners who work with other businesses and organizations with legal status by the laws of Vietnam. DN2 visa – to be granted to foreigners who come to Vietnam to offer services, establish a commercial presence or perform other activities under international treaties to which Vietnam is a member… A Vietnam company submitting a legal personal dossier to the immigration shows that they want to invite you to come and work with them.

Usually, immigration often issues 3 monthly visas for foreigners in this case. When it’s expired, you can extend it. According to Vietnam’s Law, a foreigner living and working in Vietnam for more than 3 months must have Work Permit. Sometimes foreigners could be issued multiple-12-month visas but if they’ve stayed and worked in Vietnam consecutively more than 03 months without a Work permit, it’s hard to extend the duration when their visa is expired.

List of dossiers:

  • 01 notarized copy of Certificate of Business Registration of the enterprise sponsored foreigner;
  • 01 notarized copy of Seal Certificate of the enterprise sponsored foreigner;
  • 01 copy of Passport;

Advantages:

  • Easily applying;
  • Duration is long;

Disadvantages:

  • Can not staying and working in Vietnam for more than 12 months.

2. Working Visa

The working visa for foreigners in Vietnam is symbolized as LD1 and LD2.

LD1 – to be granted to foreigners who come to work in Vietnam with a work permit exemption certificate, unless otherwise provided for in international treaties to which Vietnam is a member.

LD2 – to be granted to foreigners who must have a work permit to work in Vietnam.

This working visa is valid for up to 02 years and can be extended. But in case the work permit is valid for less than 1 year, the validity of the corresponding work visa is equal to that of the work permit.

It means that foreigners have already got a Work Permit issued by the Department of Labour, War Invalids, and Social Affairs and entry Vietnam to work. There is a case that foreigners have business visas and work permits, but they have to get a working visa to apply for a temporary residence card. In this case, if the company sponsoring them when they entered Vietnam is also the company applying a Work Permit for them, foreigners can stay in Vietnam during these procedures.

The longest duration of a working visa is 2 years but the immigration shall not issue the visa with a duration of more than 12 months. So if you want to stay and work in Vietnam for 2 years, you should apply for a temporary residence card that has the same validity as a visa. The longest duration of temporary cards is 2 years with the symbol LD.

List of dossiers:

  • 01 notarized copy of Certificate of Business Registration of the enterprise sponsored foreigner;
  • 01 notarized copy of Seal Certificate of the enterprise sponsored foreigner;
  • 01 notarized copy of Work Permit.
  • 01 original of Visa On Arrival Letter (issued when foreigner received business visa) – in case the company sponsoring them when they entered Vietnam is also the company applying Work Permit for them.

Advantages:

  • Foreigners issued with LĐ visas shall be issued temporary residence cards with the same symbols;
  • Show the purpose entry of foreigners Vietnam correctly;

Disadvantages:

  • Work Permit is required;

III. Investment visa

An investment visa is issued to foreign investors in Vietnam. People who invest to establish a company in Vietnam, which is shown in Investment Registration Certificate, don’t need to apply for Work Permit.

according to the new Immigration Law No. Law No. 51/2019/QH14 amending and supplementing several articles of the Law No. 47/2014/QH13, Vietnam Investor Law No. 51/2019/QH14 amending and supplementing several articles of the Law No. 47/2014/QH13 on entry, exit, transit and residence of foreigners in Vietnam Investor Visa is categorized into:

ĐT1 – to be granted to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with a capital contribution of at least VND100 billion, or investing in the business fields and areas of investment incentives decided by Vietnam Government. Valid for up to 5 years.

ĐT2 – to be granted to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with a capital contribution of VND50 – under VND100 billion, or investing in the business fields of investment encouragement decided by the Vietnam Government. Valid for up to 5 years.

ĐT3 – to be granted to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with a capital contribution of VND3 – under VND50 billion. Valid for up to 3 years.

ĐT4 – to be granted to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with a capital contribution of less than VND3 billion. Valid for up to 12 months.

If you want to apply for temporary residence cards, your capital must be over 3 billion VND because investors with neither ĐT4 visa nor ĐT5 visa will not be issued TRC. The duration of the ĐT1 visa reaches 10 years, ĐT2 reaches 5 years and ĐT3 reaches 3 years.

  • Foreigners issued with ĐT visas shall be issued temporary residence cards with the same symbols;
  • Show the purpose entry of foreigners Vietnam correctly;

Disadvantages:

  • Certificate of Investment registration is required;
  • Charter capital must not be too low.

In addition, every foreigner has to show the Covid-19 test negative results and complete the 21-day-quarantine.
